Damages

Our primary Litigation Support Services relates to Damages for various types of matters. Our expertise in accounting, economics, statistical analysis, income and other taxes, business valuation and mergers & acquisitions provides us with the tools necessary to define damages in a logical, clear and concise manner for a judge, jury or arbitration panel. Mike Alerding’s many years as an AAA panelist has provided him with knowledge of damages and damage calculations, and testimony that have been most successful in court or arbitration settings.

Accountants Legal Liability/Malpractice

Alerding Litigation Support Services has had extensive experience with a variety of Accountants’ Legal Liability matters, including numerous matters representing the defendant CPA firm and a few matters representing the plaintiff in litigation against a CPA firm. In this area, we are experts in both the liability and damage issues, with special emphasis on the liability issues. We have represented national, Big Four firms as well as other regional and local firms. Although most of these matters have been settled before trial or arbitration, the attorneys with whom we have worked have been complimentary of our ability to develop the case, prepare for testimony, write opinions, prepare demonstratives, prepare cross examination questions for the opposing expert and provide testimony either at trial or in deposition.

Our niche in this area has been developed through our experience in practicing public accounting, and unlike many experts in this area, we are not academics who have not actually “practiced” in public accounting. We are hands-on auditors/accountants in our everyday lives and, accordingly, provide a unique and pragmatic perspective that resonates well with triers of fact. Whether the litigation results from an audit, review, compilation, tax advice or consulting, we have the experience and expertise to assist legal counsel in developing a strong and supportable case.

Business Valuation

Business valuation services are related to estate and gift tax matters, shareholder/owner disputes, deadlocks, divorce proceedings and stock bonus valuations. The firm performs both ABV and CVA valuation reports for estate and gift tax, large shareholder disputes and divorce cases that require a formal “Full” report. The firm also uses primarily a Letter or Summary Valuation Report in providing valuation services for many of the smaller matters where a Full report is neither required nor financially feasible for the litigants. The Letter or Summary Valuation Report has been very well received in litigation matters because it provides both an effective and affordable solution for both lawyers and their clients. All of our reporting methods meet the requirements of the Federal Rules of Evidence.

Bankruptcy

Bankruptcy services include accounting, income taxes, preparation of required reports for the Bankruptcy Trustee and consulting services for legal counsel and the entity in reorganization or liquidation. These are specialized services that require an understanding of the Bankruptcy Code, including Chapters 7, 11 and 13, along with accounting and bankruptcy financial reporting expertise.

Over the years, we have been appointed accountant for the debtor and have earned an outstanding reputation for timely and affordable services in this specialized area. Our bankruptcy services include accounting, financial reporting, special projects and analyses, preparation of the Plan of Reorganization and audit procedures related to asset valuations.

Forensic Auditing/Accounting and Fraud Investigations

Forensic auditing/accounting and fraud engagements are more numerous because the economic climate continues to provide both need and opportunity. Our services in this area include fraud examinations, forensic audits, financial reporting frauds, calculations of damages, insurance settlements for fidelity bonds, internal control assessments and risk and vulnerability assessments. These engagements may arise as a result of our audit and internal audit work for clients as well as for attorneys, criminal investigators, prosecutors, Federal agencies (IRS, DOJ, etc.), banks, other lenders and bankruptcy trustees.

Alerding CPA Group has a Certified Fraud Examiner (CFE) on staff. The CFE training provides us with the credentials and knowledge necessary to develop a targeted strategy, efficiently identify the issues and report as an expert in this complex and challenging area. Our experience has included both criminal and civil actions for employee embezzlement, theft, vendor fraud, and misappropriations.

Mediation & Arbitration

Mike Alerding spent over a decade as a member of the American Arbitration Association (AAA) Large Case Arbitration Panel in the Midwest Region and has completed all required training in Alternative Dispute Resolution. With his educational background in mediation and arbitration, Mike has been accepted as a Mediator in matters where the legal process is either too expensive or where time does not allow for formal mediation. His mediation skills focus on the financial aspects of the issue and often result in a settlement that is both reasonable and cost effective for the parties.

Mike has worked as a consultant for attorneys in matters dealing primarily with damage calculations in mediation or arbitration matters. Mike’s role in these engagements includes assisting in developing strategies for determining damages, interviewing witnesses, cross examination of witnesses and in explaining complex financial and accounting issues.
